Terms & Conditions The following terms and conditions apply to all online courses offered by the Good Tourism Institute. By completing the registration process and confirming to buy online courses by the Good Tourism Institute, you are stating you are eligible for an account and that you agree to be bound by GTI’s terms and conditions without modification. Article 1: Online course provider 1.1 The online courses are provided by the Good Tourism Institute (hereinafter referred to as GTI), a company incorporated in the Netherlands with Chamber of Commerce registration number 82098298 and with its registered office at Stationsweg 92-504, Ede, the Netherlands. Article 2: Definitions 2.1 The following terms used in this document have the following meaning: account refers to the online user account created for the use of the online course online course refers to an individual course provided by GTI course materials refers to the content of the online course provided by GTI course platform refers to the website where the online courses are accessible servers refers to the servers controlled by GTI (or a third hosting party) upon which the online courses and customer data are stored you refers to the individual purchasing an online course course fee refers to the fee payable to access an online course Article 3: Fees and services 3.1 GTI may change its fees and payment policies for the course platform from time to time including but not limited to the addition of costs for excessive data transfer rates for individual or corporate customers. 3.2 The changes to the fees or payment policies are effective upon your acceptance of such changes which will be posted at goodtourisminstitute.com. Unless otherwise stated, all fees are quoted in European Euros (€). Article 4: Purchasing and confirmation 4.1 In order to purchase an online course, you must provide the required information in the registration form. You must ensure that all information provided is complete and accurate. 4.2 In order to purchase an online course, you must pay the amount specified. 4.3 A legally binding agreement shall only come into existence once: GTI has accepted your offer to purchase an online course by sending you an order confirmation email. GTI has received full online payment of the entire course fee. 4.4 You must check the details on the order confirmation email when you have received it. If there are any errors, please contact GTI immediately to correct your details at: info@goodtourisminstitute.com. 4.5 GTI reserves the right, in its sole and absolute discretion and without the need to give a reason, to refuse to accept an offer to purchase one or more online courses. In such circumstances, no contract will arise and GTI will return any payment accompanying your purchase offer. Article 5: Payment 5.1 The course fee should be paid in full when purchasing the online course. GTI does not accept payment in instalments. 5.2 All amounts are payable in Euros (€). The prices quoted are exclusive of VAT. Any currency conversion costs or other charges incurred in making payment shall be covered by yourself. It shall not be deductible from the amounts due to GTI. 5.3 The course fee is paid on GTI’s course platform and through its adhering payment system. Payments are accepted through PayPal, Credit card (including Visa, MasterCard and American Express) and iDeal. 5.4 In the unlikely event that your purchase offer was accepted at a time when the amount of the course fee displayed on the website was incorrect, GTI will notify you as soon as possible. If the correct amount of the course fee is higher than the amount displayed on the website, GTI will contact you to notify you of the correct course fee. You can then decide whether or not to continue with your order of the online course at the increased course fee. If you decide to cancel your order, GTI will provide you a full refund in respect of any amount you have already paid. If the correct course fee is lower, GTI will refund you the difference between the amount which you have paid and the correct payable course fee. Article 6: Cancellation policy 6.1 Generally, GTI’s online courses are not eligible for a refund or cancellation. We may approve a refund request, provided you meet the following requirements: you must notify us with your cancellation request in writing within 24 hours of placing the online order. Requests must be sent via email to info@goodtourisminstitute.com; and you must not have completed more than 10% of the online course. 6.2 GTI’s online courses cannot be transferred to another individual than yourself. Article 7: Member account, password and security 7.1 When purchasing an online course and completing the registration process, you will receive a member account on GTI’s course platform. Your e-mail address will serve as username and password will be chosen by yourself. Passwords can be changed in your member account. 7.2 You shall protect your password and use of your account. You are solely responsible for all activities that occur in your account. You agree to notify GTI immediately upon learning of any unauthorised use of your account or any other breach of security. Article 8: Intellectual property 8.1 At all times, GTI remains the owner of the intellectual property in the online courses and the course materials. Other than as specified below, no online course and/or course materials, nor any part of it may be reproduced, stored in a retrieval system or transmitted in any form or by any means without the prior written permission of GTI. 8.2 In consideration of receipt by GTI of the entire course fee, GTI grants to you a non-exclusive, non-transferable licence to access the online course and use of the course materials content for the sole purpose of studying for the online course. 8.3 Subject to the terms and conditions of this Agreement, you may remotely access and view course materials. Your license of use and access to the GTI course materials is conditioned upon your compliance with the terms and conditions of the Agreement, including the following: you will not allow any third party to copy, modify, adapt, translate or otherwise create derivative works of the GTI course materials; reverse engineer, de-compile, disassemble or otherwise attempt to discover the source file content of the training materials, except as expressly permitted by the law in effect in the jurisdiction as course client of GTI; rent, lease, sell, assign or otherwise transfer rights in or to the training materials, or the online course; you will use the software and content materials solely for your own internal use and will not make the software available to others; and you will not download course materials from the online course within the first 24-hour cancellation time frame. Article 9: Online course content and access terms 9.1 The description of the online course on the website will set out details of the content of the available online courses. 9.2 Unless described in the course description on the website, no additional course material or coaching will be provided by GTI. 9.3 Upon receipt of your purchase and confirmation email by GTI, you will be provided with log-in details to the course platform and access to the online course. 9.4 After purchasing an online course, you will have access for 12 months after which your access to the online course will be disabled. 9.5 You acknowledge that GTI operates a zero-tolerance policy in relation to inappropriate behaviour of students. In particular, abusive or violent behaviour directed at GTI staff or other students and unfair or dishonest practices will not be tolerated under any circumstances. GTI may, in its reasonable discretion and without liability or an obligation to refund any course fee, refuse to supply any online course to any student who engages in inappropriate behaviour. Article 10: Modifications to online courses or technology enhancements 10.1 From time to time, GTI may make modifications or enhancements to its online courses. You will have access to such changes free of charge only to the extent that such changes relate to the online course purchased by you and only within your online course access (12 months). 10.2 Purchase of an online course does not entitle you to have access to future revised online courses as part of the original purchase. Article 11: Technical support 11.1 If you are unable to access an online course, GTI will use reasonable endeavours to provide a solution where GTI has direct control over the system, software or settings involved. If the issue lies with your hardware, systems, software or settings thereof, GTI may, in its discretion, provide assistance to you to help you resolve the issue but cannot guarantee that any assistance provided will resolve your issue. 11.2 You accept and acknowledge that periods of downtime may be required in respect of the information technology infrastructure connected to the website and that technical assistance may not be available during such periods of downtime. Further you accept that you will not make a claim for breach of contract or otherwise in respect of such period of unavailability. 11.3 GTI will use reasonable endeavours to make the online course available but cannot guarantee uninterrupted, timely or error free availability or that defects will be corrected. GTI reserves the right to suspend access to the website for the purpose of scheduled or emergency maintenance, repairs or upgrades to improve the performance or functionality of the website. 11.4 In case of planned period of maintenance, you will be informed accordingly. 11.5 You also accept and acknowledge that GTI cannot be held responsible for any delay or disruptions to your access to the online course as a result of such suspension or any of the following: the operation of the internet and the world wide web, including but not limited to viruses; any firewall restrictions that have been placed on your network or the computer you are using to access the online course; failures of telecommunications links and equipment; or updated browser issues. Article 12: Disclaimer of warranties 12.1 GTI will provide the course materials in accordance with the online course description, which is set out on the website. 12.2 GTI expects you to take reasonable care to verify that the online course and course materials in question will meet your needs. GTI does not make any commitment to you that you will obtain any particular result from your use of the online course or course materials or that you will obtain any particular qualification on completion of the online course other than a completion certificate. 12.3 GTI does not make any representation, guarantee or commitment to you that the online course or course materials will be error free. 12.4 GTI does not make any commitment that the online course or course materials will be compatible with or operate with your software or hardware. 12.5 All representations, warranties and/or terms and/or commitments not expressly set out in these terms and conditions (whether implied by law, conduct, statute or otherwise) are hereby excluded to the maximum extent permissible at law. Article 13: Limitation of liability 13.1 The exclusions and limitations of liability contained in these terms and conditions do not apply to a party’s liability: for fraud or wilful default; for death or personal injury caused by its negligence; or where such limitation or exclusion cannot lawfully be excluded. 13.2 Except as set out in these terms and conditions, GTI shall not be responsible for losses that result from its failure to comply with these terms and conditions including, but not limited to, losses that fall into the following categories: indirect or consequential losses; loss of income or revenue; loss of business; loss of anticipated savings; loss or corruption of data. 13.3 GTI is not responsible for any data you lose either as a result of accessing the online course or the course materials or during completion of any online course via GTI’s website. 13.4 It is your responsibility to ensure you regularly save and back up all data which you hold on the computer from which you are accessing the online course and all data that you are inputting when completing the online course. 13.5 GTI’s maximum aggregate liability to you for any claims you may have against GTI for direct loss in contract, tort or otherwise arising out of or in connection with the online course, shall be limited to the amount of the course fee which has been paid, or is payable, by you. 13.6 GTI will not be held responsible for any delay or failure to comply with its obligations under these terms and conditions if the delay or failure arises from any cause beyond GTI’s reasonable control. This condition does not affect your statutory rights Article 14: Complaints 14.1 If you are dissatisfied with the online courses or additional services provided by GTI, you must inform GTI as soon as possible by sending an email to info@goodtourisminstitute.com. The email should include a clear description of the complaint for GTI to be able to respond and if the complaint is well founded, to rectify. Complaints that are not clearly described cannot be processed. 14.2 GTI must be notified of any queries or complaints within 14 days of purchasing an online course. If you do not notify GTI within this time period, GTI will not be obliged to correct your order and will not be responsible for any loss or damage suffered by you as a result. 14.3 Complaints submitted will be answered within 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, a reply will be given within 14 days with a confirmation of receipt and an indication when a more detailed answer can be expected. 14.4 When a complaint is sent, your obligation to make payment continues to exist. Article 15: Privacy, data protection and confidentiality 15.1 GTI will process the information it receives from you or otherwise holds about you in accordance with these terms and conditions and its privacy policy. Article 16: Modifications to terms of service 16.1 GTI reserves the right to change or modify any of the terms and conditions contained in this Agreement at any time, by publishing the new agreement on https://goodtourisminstitute.com. You are responsible for regularly reviewing the policy. 16.2 No modification of this Agreement will be binding unless: confirmed in writing and signed by a co-founder of GTI; or you accept updated terms online; or you continue to use the course platform after GTI has published updated terms and conditions on its website.
